National Innovation Visa (NIV Visa) Class BX, Subclass 858 Visa

The National Innovation Visa (NIV Visa) was formerly known as the Global Talent Visa. It is designed to attract exceptionally talented individuals who are internationally recognised in their field. It provides a streamlined pathway to Australian permanent residency for leaders in targeted sectors such as technology, health, energy, research and academia.

On 7 December 2024, the National Innovation Visa superseded the Global Talent Visa as the pathway for exceptionally skilled individuals in key sectors to permanently migrate to Australia.

Many aspects of the GTV carry over to the NIV:

  • Having an internationally recognised record of exceptional and outstanding achievement is still a key requirement.
  • Whether the applicant earns at or above the Fair Work high income threshold is still a measure of the applicant’s suitability.
  • The applicant must be nominated.

The key differences between the two visas are as follows:

  • Whereas the applicants of the GTV can be nominated without an invitation, the NIV requires the applicant to be invited in addition to being nominated.
  • Invitations are now processed and extended following a tiered priority order system.
  • Submitting an EOI is now a mandatory part of the process.
  • State and territory governments can nominate NIVs whereas they could not nominate GTV.

Common Issues When Applying for the NIV Visa Australia

  • Difficulty in demonstrating international recognition or a record of exceptional achievements.
  • Unclear evidence connecting the applicant’s achievements to one of Australia’s target sectors.
  • Receiving a section 57 “Natural Justice” letter from the Department questioning the authenticity or accuracy of information provided.
  • Lack of a qualified nominator who can credibly endorse the applicant’s standing in their field.

Suggested Solutions

Success under the National Innovation Visa program depends heavily on presentation and evidence.

  • Prepare comprehensive documentation that clearly demonstrates international recognition, recent achievements and the applicant’s ability to contribute to Australia’s economy or innovation landscape.
  • Ensure that your nominator is reputable, eligible and able to speak credibly to your professional accomplishments.
  • If issued a section 57 Natural Justice letter, respond promptly and transparently, addressing each allegation carefully and providing clear supporting documentation.
