partner visa granted 2 days

To get a fast grant, you want to make sure that all legal requirements are supported by evidence.

Partner visas can now be granted rather quickly. However, it can be slowed down if you do not provide an application with full supporting documents. Once we assisted the client in cleaning up their application and covering all the legal requirements they missed, their partner visa was granted in 2 days.

Background

The client’s partner visa application was previously handled and lodged by an unregistered agent based overseas.

Given that our client did not live in their own country but rather lived in another country for work, they were rather desperate to obtain the visa grant so they could move their entire family together back to Australia.

The application was lodged in September 2019 and the client had asked the other agent to request for the Department to expedite the application to no success.

We got them the partner visa granted within 2 business days.

Difficulties with this case

It is always difficult to take over a case from another agent because you have to start reviewing the case from scratch, identifying any mistakes on the way and also strategising on how to fix the issue such that it would not raise further complications for inconsistency.

As we were reviewing the application, we found multiple issues with the application:

  • No supporting evidence was uploaded except for marriage certificate, identity documents, previous divorce document, police checks and their daughter’s birth certificate;
  • No sponsorship application was lodged;
  • The Sponsor’s name was filled in incorrectly; and
  • The client was not properly advised of their eligibility for a ‘double grant’ if they had delayed the application by 2-3 months.

When handling these cases we have to be quick to race against the clock (because these issues can only be fixed before a decision is reached by the Department) whilst also being meticulous in our work.

It was obvious that the application was lacking because it did not have any supporting evidence to support the 4 aspects of a genuine and continuing relationship:

  • Financial Aspect
  • Social Aspect
  • Nature of Household
  • Nature of Commitment

For more information on the assessment criteria for partner visas, please refer to our partner visa page.

We assisted the client in gathering more supporting evidence by brainstorming with them different ideas and guiding them on how they can present those aspects clearly to the Department. As a last measure, we also drafted a legal submission which collated all evidence together, backed up by case law interpretation and an explanation on how they meet specific legal criteria as required for the grant of the partner visa.

Once we submitted all this extra information which filled in all the gaps of the application, the Department immediately granted the partner visa to the client within 2 business days. The Department made no further requests for any documents.

It is clear that the previous agent’s attempt to simply ask the Department to expedite the grant was not successful because the application was incomplete. The processing time of the application can be greatly shortened if you present a clear, convincing and complete application to the Department.

    Partner Visa - Grant in 2 business days

    Partner visa granted in 2 business days after taking over case

    I approached Adele Wan when I was desperate. I applied a partner visa in September 2019 and I live in the Middle East. If you ever worked in the Middle East you would understand how connected your life is to your work place (Insurance, residence, family …. Ect.) and once your job decide to leave you the country finds no reason for you to stay and you must move. I applied partner visa so I can guarantee there is somewhere else for me and my family to move to as a package and without being divided. I hired an agent in Qatar and I did not know any better. They submitted my partner visa application and completely relied on my marriage contract and the fact that myself and my wife share a child. In their understanding this was sufficient to get us our visa. Not to mention the poor knowledge they had regarding the requirements for double grant. I approached Adele, and after one legal consultation I was convinced she understands what she was doing, she explained everything very well and made a very good presentation. She took her time and gathered all evidence. We provided her with information we didn’t know we had it, but somehow she knew and she got it out of us. She made sure all four aspects of relationship was covered and made a perfect legal submission. Every line she wrote down in her statement was backed up by a clause from the immigration law. She applied and we were awarded in 3 days. Her prices was reasonable compared to the peace of mind we had after! Thank you again Adele and Brightstone.
