in Australia, it is subject to natural justice and procedural fairness.<\/span><\/p><p><span style=\"font-weight: 400;\">Essentially the fundamental concept of natural justice is that everyone is entitled to\uff1a<\/span><\/p><ul><li style=\"font-weight: 400;\"><b>A right to respond<\/b><span style=\"font-weight: 400;\"> to negative allegations or comments<\/span><\/li><li style=\"font-weight: 400;\"><b>A right to be heard <\/b><span style=\"font-weight: 400;\">by an independent and impartial tribunal\u00a0<\/span><\/li><li style=\"font-weight: 400;\"><b>A decision that is impartial and unbiased<\/b><\/li><\/ul><p>The aim is to ensure that all decision-making is fair.\u00a0<\/p><p><span style=\"font-weight: 400;\">If you have received a negative decision from the Department (i.e. a <b>visa refusal<\/b> or a decision to cancel your visa) you will almost always have a <b>right to appeal<\/b> this decision for reconsideration by the Administrative Appeals Tribunal.<\/span><\/p><p>There are, however, certain circumstances where this is not possible, such as if you are not in Australia, if you did not appeal within the specified timeframe, or if you are not the correct person to be lodging the appeal etc.<\/p><p><span style=\"font-weight: 400;\">Even if you are unable to appeal to the Administrative Appeals Tribunal, you may still have an opportunity to appeal to the legal forums of Australia such as the Federal Circuit Court of Australia or Federal Court of Australia.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Once you enter the space of appeals, we would strongly recommend that a <a href=\"https:\/\/www.blmigration.com.au\/en\/service\/book-a-consultation-with-us\/\">lawyer is consulted<\/a> as there are very specific legal
