To lodge a further non-exempt visa application, you will generally need to depart Australia and apply from offshore.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-628a597 elementor-widget elementor-widget-heading\" data-id=\"628a597\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">When Does the Section 48 Bar Apply?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc99e7b elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"dc99e7b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Section 48 bar applies where all of the following circumstances exist:<\/p><ul><li>you are physically present in Australia;<\/li><li>you do not hold a substantive visa (for example, you hold a Bridging Visa or are unlawful); and<\/li><li>since your last entry into Australia, you have had a visa application refused or a visa cancelled.<\/li><\/ul><p>A substantive visa generally includes visas such as:<\/p><ul><li>Student visas;<\/li><li>Skilled visas;<\/li><li>Partner visas; and<\/li><li>Temporary Work visas.<\/li><\/ul><p>Importantly, if you still hold a valid substantive visa at the time a visa refusal occurs, the Section 48 bar will generally not be triggered.<\/p><p>It is also important to distinguish between a visa refusal and an invalid application. If a visa application is found to be invalid, for example, due to incorrect lodgement, missing requirements, or payment issues, no refusal occurs. Applying for an Exempt Visa Category<\/strong><\/span><\/p><p>If you are eligible for a visa that is exempt from the Section 48 bar, such as a Partner visa or certain skilled regional visas, you may still be able to lodge an onshore application.<\/p><p>However, additional requirements may apply. For example, applicants who no longer hold a substantive visa may need to satisfy Schedule 3 criteria, which impose stricter requirements for certain onshore visa applications.<\/p><p><span style=\"text-decoration: underline;\"><strong>3. Consider an Offshore Application Strategy<\/strong><\/span><\/p><p>In some situations, the most practical option may be to depart Australia and apply from overseas.<\/p><p>This commonly involves:<\/p><ul><li>applying for a Bridging Visa B (if eligible);<\/li><li>departing Australia lawfully; and<\/li><li>lodging a fresh visa application offshore.<\/li><\/ul><p>Once outside Australia, the Section 48 bar no longer applies.
