On 4 September 2025, the Minister for Immigration and Citizenship, The Hon Tony Burke MP, introduced new Ministerial Instructions and Personal Procedural Decisions (PPDs) that change how refused visa applicants can request the Minister\u2019s help.<\/p><p>If you are considering a Ministerial Intervention request or seeking options after a visa refusal, here\u2019s everything you need to know about the new rules and how they may affect your case.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9875376 elementor-widget elementor-widget-heading\" data-id=\"9875376\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What is Ministerial Intervention?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0272b2c elementor-widget elementor-widget-text-editor\" data-id=\"0272b2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Ministerial Intervention is a process that allows the Minister to personally review a case and, in rare situations, grant a more favourable decision when it is in the public interest.<\/p><p>Under the Migration Act 1958 (Cth), the Minister can intervene under:<\/p><p><strong>Section 351 \u2013 General visa refusals<\/strong><br \/>Allows the Minister to substitute a more favourable decision after an ART affirming a refusal.<\/p><p><strong>Section 501J \u2013 Protection visa refusals<\/strong><br \/>Allows intervention in protection visa matters where the ART has upheld the refusal.<\/p><p><strong>Section 46A and 48B \u2013 Bar lift requests<\/strong><br \/>Applicants blocked by the section 46A bar or section 48 bar can request the Minister to lift the restriction so they can lodge a valid visa application.<\/p><p><strong>Important:<\/strong> The Minister\u2019s powers are discretionary and non-compellable \u2013 meaning the Minister can choose not to consider or act on any request.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-edc7769 elementor-widget elementor-widget-heading\" data-id=\"edc7769\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Why the 2025 Migration Law Changes Matter<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6bcbbfe elementor-widget elementor-widget-text-editor\" data-id=\"6bcbbfe\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>A 2023 High Court decision (Davis v Minister for Immigration) ruled that DHA officers could not decide which cases should be considered by the Minister. This created processing uncertainty and delays.<\/p><p>The new Instructions issued in September 2025 aim to:<\/p><ul><li>restore administrative efficiency<\/li><li>introduce clear and objective referral criteria<\/li><li>reduce the backlog of old requests<\/li><li>improve transparency for applicants<\/li><\/ul><p>These changes reshape which cases will reach the Minister\u2019s desk and which will be finalised by the Department.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-80f5d43 elementor-widget elementor-widget-heading\" data-id=\"80f5d43\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">New Referral Criteria for Sections 351 and 501J<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-382909a elementor-widget elementor-widget-text-editor\" data-id=\"382909a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The new Instructions establish two filters:<\/p><p><strong>1.When a request is \u201cinappropriate for referral\u201d<\/strong><\/p><p>A request will not be referred to the Minister if:<\/p><ul><li>it is unmeritorious or repeated<\/li><li>the applicant is offshore<\/li><li>the applicant is an Australian citizen or permanent resident<\/li><li>the applicant does not hold at least a bridging visa<\/li><li>another visa application is already pending<\/li><\/ul><p>These requests will be finalised by DHA officers.<\/p><p><strong>2.Positive referral criteria<\/strong><\/p><p>A request must also meet one of the following to be eligible:<\/p><ul><li>Applicant is working in a relevant skilled occupation<\/li><li>Applicant is an essential carer of an Australian citizen requiring care<\/li><li>Applicant is a parent of an Australian citizen or permanent resident child<\/li><li>Applicant arrived in Australia as a minor, has lived here for over 50% of their life, and would face mental or physical harm if returned overseas<\/li><\/ul><p>Only requests that satisfy these criteria may be sent to the Minister on a full submission.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-782889c elementor-widget elementor-widget-heading\" data-id=\"782889c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Changes to Section 46A and 48B Bar Lift referred<\/strong><\/p><ul><li>Improperly made requests<\/li><li>Repeated requests<\/li><li>Requests made while another application is pending<\/li><\/ul><p><strong>2.When bar lift requests MAY be referred<\/strong><\/p><p>Only exceptional circumstances (e.g. changes to non-refoulement obligations) will justify a full submission.<\/p><p>Most bar lift requests will instead be forwarded as summary submissions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1838f7a elementor-widget elementor-widget-heading\" data-id=\"1838f7a\" if the applicant:<\/p><ul><li>is onshore,<\/li><li>is unlawful or holding a bridging visa, and<\/li><li>has no ART or Federal Court matters pending<\/li><\/ul><p>Applicants in this group may reapply
