In Canberra, the Administrative Review Tribunal and Other Legislation Amendment Bill 2025 has passed the House of Representatives and is now progressing through the Senate, proposing significant changes to the Administrative Review Tribunal (ART) and the <em>Migration Act 1958<\/em>.<\/p><p>Meanwhile, several states and territories have confirmed their skilled migration allocations for the 2025\u201326 program year, and the Department of Home Affairs has announced an upcoming invitation round for the <a href=\"https:\/\/www.blmigration.com.au\/service\/i-need-a-work-visa-for-australia\/independent-visa\/skilled-independent-visa-subclass-189\/\">Skilled Independent (Subclass 189) visa<\/a>, scheduled for 13 November 2025.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9875376 elementor-widget elementor-widget-heading\" data-id=\"9875376\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">State and Territory Updates<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0272b2c elementor-widget elementor-widget-text-editor\" data-id=\"0272b2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Good news for skilled migration applicants: <strong>New South Wales, Australian Capital Territory and Tasmania<\/strong> have now confirmed their allocations for the 2025\u201326 program year:<\/p><p><strong>New South Wales<\/strong> \u2013 Total allocation: <strong>3,600 places<\/strong><\/p><ul><li>2,100 places for the Skilled Nominated (Subclass 190) visa<\/li><li>1,500 places for the Skilled Work Regional (Subclass 491) visa<\/li><\/ul><p><strong>Australian Capital Territory (ACT)<\/strong> \u2013 Total allocation: <strong>1,600 places<\/strong><\/p><ul><li>800 places for the Skilled Nominated (Subclass 190) visa<\/li><li>800 places for the Skilled Work Regional (Subclass 491) visa<\/li><\/ul><p><strong>Tasmania<\/strong> \u2013 Total allocation: <strong>1,850 places<\/strong><\/p><ul><li>1,200 places for the Skilled Nominated (Subclass 190) visa<\/li><li>650 places for the Skilled Work Regional (Subclass 491) visa<\/li><\/ul><p><strong>Western Australia<\/strong> and <strong>South Australia<\/strong> have yet to confirm their full allocations but have been provided with interim figures. Western Australia will use its interim allocation to conduct a November invitation round, while South Australia will continue inviting applicants, including those who submitted a Registration of Interest (ROI) during the 2024\u201325 program year.<\/p><p>Allocations for Victoria, Queensland and the Northern Territory are still pending confirmation.<\/p><p>Both the <a href=\"https:\/\/www.blmigration.com.au\/service\/i-need-a-work-visa-for-australia\/state-territory-nominated-visas\/skilled-nominated-visa-subclass-190\/\">Skilled Nominated (Subclass 190)<\/a> and <a href=\"https:\/\/www.blmigration.com.au\/service\/i-need-a-work-visa-for-australia\/state-territory-nominated-visas\/skilled-work-regional-provisional-visa-subclass-491\/\">Skilled Work Regional (Subclass 491) visas<\/a> require nomination by a state or territory government and are points-tested pathways to Australian residency. Under the proposed changes, the Tribunal may choose to do so if:<\/p><ol><li>The issues can be adequately determined without a hearing;<\/li><li>It is reasonable to make a decision without holding a hearing; and<\/li><li>The parties have been given a reasonable opportunity to make submissions on whether a hearing should be held.<\/li><\/ol><p>These discretionary powers will remain subject to section 55 safeguards, ensuring that parties have a reasonable opportunity to present their case.<\/p><p>In addition, certain applications \u2013 such as reviews of student visa refusals and temporary visa refusals or cancellations prescribed by regulation \u2013 will require the Tribunal to decide the matter on the papers. However, these provisions will not apply to permanent or protection visa reviews or cases involving refusals or cancellations under specified Public Interest Criteria.<\/p><p>These reforms aim to improve the Tribunal\u2019s efficiency in managing its caseload, but they also underscore the importance of carefully prepared written submissions and evidence.
