However, later that year, she was convicted of <a href=\"https:\/\/brightstonelegal.com.au\/criminal\/service\/%e5%88%91%e4%ba%8b%e6%8c%87%e6%8e%a7%e5%88%86%e7%b1%bb\/%e6%99%ae%e9%80%9a%e8%a2%ad%e5%87%bb\/\"><span style=\"color: #bc943e;\">Common Assault<\/span><\/a> (domestic violence-related) and Property Damage, resulting in a 12-month Community Correction Order and Fines.<\/p><p>Despite fully disclosing their criminal history, her second Working Holiday visa application was refused under section 501(1) of the Act on the grounds that she failed the <a href=\"https:\/\/www.blmigration.com.au\/en\/service\/i-have-a-criminal-record-health-issue-and-my-visa-may-be-refused\/character-requirement\/\"><span style=\"color: #bc943e;\">character test<\/span><\/a>. The Department assessed her conviction as an indicator of potential future risk, particularly due to the involvement of family violence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-492d9ca elementor-widget elementor-widget-heading\" data-id=\"492d9ca\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What is Section 501: Character Requirements?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0854b94 elementor-widget elementor-widget-text-editor\" data-id=\"0854b94\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Under section 501(1) of the Act, the Minister may refuse to grant a visa if the applicant does not satisfy the Minister that they meet the character test. The client had no prior or subsequent legal issues. We argued that one mistake should not define an individual, particularly when there is clear evidence of rehabilitation. The client took full responsibility for the incident, cooperated with authorities and successfully completed all legal obligations. The victim did not sustain injuries, and there was no ongoing threat after the incident.
