However, this decision is not automatic and must consider a range of factors as outlined in Ministerial Direction No. 110, including:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e776b36 elementor-tabs-view-horizontal elementor-widget elementor-widget-tabs\" data-id=\"e776b36\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"tabs.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-tabs\">\n\t\t\t<div class=\"elementor-tabs-wrapper\" role=\"tablist\" >\n\t\t\t\t\t\t\t\t\t<div id=\"elementor-tab-title-2421\" applicant&#8217;s conduct, as well as the potential risk of re-offending.<\/p><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"2\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-2422\" aria-expanded=\"false\">Family violence<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2422\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-2422\" tabindex=\"0\" hidden=\"hidden\"><p>Consideration of whether the applicant&#8217;s conduct involved domestic violence.<\/p><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"3\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-2423\" aria-expanded=\"false\">Ties to Australia<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2423\" class=\"elementor-tab-content aria-controls=\"elementor-tab-content-2424\" aria-expanded=\"false\">Best interests of minor children<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2424\" class=\"elementor-tab-content data-id=\"fe8e4af\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>These factors guide the Minister in determining whether to exercise discretion and grant a visa despite the applicant\u2019s failure to meet the character test.<\/p><p>In our client\u2019s case, the issue stems from an isolated domestic violence incident, which was addressed through the issuance of an ADVO. While an ADVO does not equate to a criminal conviction, its presence may still influence the Minister\u2019s discretionary decision-making process, potentially affecting the outcome of the visa application.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47c0aa9 elementor-widget elementor-widget-heading\" data-id=\"47c0aa9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Turning over a new leaf<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6145900 elementor-widget elementor-widget-text-editor\" data-id=\"6145900\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>In light of the isolated nature of this incident, our client has demonstrated a strong commitment to self-improvement and to adhering to the legal orders that were implemented.<\/p><p>Following the altercation, our client has consistently prioritised the well-being of his family.
