provisions, he faced the possibility of prolonged immigration detention and removal from the country where he had built his life over many years.<\/p><p>Following detailed legal submissions and sustained advocacy by Brightstone Legal, the Department of Home Affairs decided to revoke the mandatory <a href=\"https:\/\/www.blmigration.com.au\/service\/i-have-a-criminal-record-health-issue-and-my-visa-may-be-refused\/character-requirement\/\">visa cancellation under section 501CA(4)<\/a> of the <em>Migration Act 1958 (Cth).<\/em><\/p><p>As a result, our client\u2019s permanent visa was reinstated, he was released from immigration detention, and he was able to reunite with his family in Australia.<br \/><br \/>For our client, the decision meant being able to remain in Australia and continue rebuilding his life with the support of his family and community.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2c7f8c8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2c7f8c8\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-no\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Case Background<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-408da6d elementor-widget elementor-widget-text-editor\" data-id=\"408da6d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Our client had lived in Australia for many years and had developed strong personal, family and community ties in Australia.<\/p><p>Following a criminal conviction that resulted in a custodial sentence, his visa was mandatorily cancelled under section 501(3A) of the <em>Migration Act<\/em>. The cancellation occurred because the sentence met the statutory threshold for a \u201csubstantial criminal record\u201d under section 501(7) of the Act.<\/p><p>After completing his custodial sentence, he was transferred into immigration detention while his revocation request was considered. In mandatory character cancellation matters, affected individuals are often unable to apply for a bridging visa while awaiting a decision. This can result in a person remaining in immigration detention for a significant period despite having completed their criminal sentence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d51105c elementor-widget elementor-widget-heading\" data-id=\"d51105c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Legal Framework<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-245573a elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"245573a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Section 501(3A) of the Migration Act requires the mandatory cancellation of a visa where a person does not pass the character test because they have a substantial criminal record and are serving a full-time custodial sentence.<\/p><p>Once a visa has been cancelled under this provision, the available pathway is to seek revocation under section 501CA.<\/p><p>Where a person cannot satisfy the character test, the key question for the decision-maker is whether there is <strong>\u201canother reason\u201d<\/strong> why the original cancellation decision should be revoked.<\/p><p>That assessment is governed by Ministerial Direction No. 110, which requires decision-makers to consider a range of mandatory considerations, including:<\/p><ul><li>the protection of the Australian community;<\/li><li>the nature and seriousness of the offending;<\/li><li>the strength, nature and duration of the person&#8217;s ties to Australia;<\/li><li>the best interests of any affected children; and<\/li><li>the impact that removal would have on the person and their family.<\/li><\/ul><p>Obtaining revocation at the departmental delegate stage can be challenging, particularly where the person has received a custodial sentence. These matters require careful preparation, comprehensive evidence and a clear response to the legal framework.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e1481ee elementor-widget elementor-widget-heading\" data-id=\"e1481ee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Our Approach<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f7deb6 elementor-widget elementor-widget-text-editor\" data-id=\"6f7deb6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Brightstone Legal prepared and lodged detailed legal submissions addressing each of the relevant considerations under Ministerial Direction No. 110.<\/p><p>The evidence was carefully organised to assist the delegate in understanding the client\u2019s circumstances, including his rehabilitation, conduct, family support, ties to Australia and future risk.<\/p><p>Where the Department relied on material from the criminal proceedings, our team responded by directing attention to factors that supported revocation, including:<\/p><ul><li>the relevant findings regarding the mitigating circumstances of the offending;<\/li><li>our client\u2019s prospects of rehabilitation; and<\/li><li>the relevant legal authorities governing the exercise of the delegate\u2019s discretion under section 501CA.<\/li><\/ul><p>An important part of the case was the client\u2019s conduct following the offending. Evidence was presented to show his efforts toward rehabilitation, his positive conduct during the relevant period, and the practical steps he had taken to reduce future risk.<\/p><p>We also provided evidence of the hardship that removal would cause to close family members in Australia, as well as the client\u2019s continuing connection to the Australian community.<\/p><p>Every aspect of the material was structured to address the matters the delegate was legally required to consider.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0d82da7 elementor-widget elementor-widget-heading\" data-id=\"0d82da7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Outcome<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ec81412 elementor-widget elementor-widget-text-editor\" data-id=\"ec81412\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Department ultimately accepted that there was \u201canother reason\u201d to revoke the mandatory cancellation.<\/p><p>The cancellation decision was revoked under section 501CA(4) of the Migration Act. As a result, our client\u2019s permanent visa was restored with the legal effect that the cancellation was taken not to have occurred.<br \/><br \/>Following the decision, our client was released from immigration detention and reunited with his family.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a0db1c elementor-widget elementor-widget-heading\" data-id=\"1a0db1c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Why This Case Matters<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77cbf1f elementor-widget elementor-widget-text-editor\" data-id=\"77cbf1f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Mandatory character cancellations under section 501 can have serious and far-reaching consequences. Once a visa is cancelled, a person may be detained while their revocation request is considered, often without the ability to apply for a bridging visa.<\/p><p>Although every case depends on its own facts, this matter demonstrates the importance of presenting comprehensive and well-supported evidence.
